Apostille vs Embassy Attestation: Which One Do You Need?

Updated 8 November 2026

When a document issued in India has to be used abroad, the receiving authority needs proof that the signature and seal on it are genuine. There are two ways to provide that proof: an apostille or embassy (consular) attestation. Which one you need depends almost entirely on the destination country.

The short answer

  • Apostille: for countries that are parties to the 1961 Hague Apostille Convention (for example the USA, UK, France, Italy, Australia, Canada, Saudi Arabia, Oman and China). One certificate from the Ministry of External Affairs (MEA) is enough, and no embassy stamp is needed.
  • Embassy attestation: for countries outside the Convention (for example the UAE, Qatar, Kuwait and Egypt). After MEA attestation, the destination country's embassy or consulate in India must also attest the document, and some countries add a final stage after arrival.

What both routes have in common

Both routes usually start the same way. The document is first authenticated by the authority responsible for it in India: the State Home or General Administration Department for personal documents, the State Education Department (often after university verification) for educational documents, or a Chamber of Commerce for commercial documents. Some documents, such as affidavits and powers of attorney, are notarised first.

How the apostille route works

  1. Notarisation, where the document type requires it
  2. State authentication or Chamber of Commerce
  3. MEA apostille, a certificate that can be verified online

How the embassy attestation route works

  1. Notarisation, where required
  2. State authentication or Chamber of Commerce
  3. MEA attestation
  4. Attestation by the destination's embassy or consulate in India
  5. Any post-arrival stage, such as MoFA attestation in the UAE or Qatar

Exceptions worth knowing

  • Germany: Germany is a Convention member, but it objected to India's accession, so the Indian apostille does not apply between the two countries. Documents for Germany go through the German Embassy/Consulates instead.
  • Recent members: Saudi Arabia (December 2022), China (November 2023) and Canada (January 2024) moved from embassy attestation to the apostille. Old checklists may still mention embassy stamps.
  • Not every use needs either: some visa and university applications accept originals or certified copies. Always read the receiving organisation's instructions first.
